By downloading, installing, or using the Industrial Equipment Setting Estimator ("IESE," "the Software"), including the free demo version, you agree to the terms below. If you do not agree, do not use the Software.

1. Professional Judgment Required

IESE is an estimating aid, not a substitute for professional estimating practice. The user remains solely responsible for the accuracy and suitability of every estimate produced with the Software, including verification of quantities, scope, labor rates, equipment and material pricing, site conditions, productivity assumptions, and the final bid amount.

The manhour database and other values supplied with the Software are reference starting points reflecting the author's experience. They are not guarantees of field production on any particular project. Users are expected to apply proper estimating techniques and procedures — including independent takeoff verification, site-specific adjustment, peer review, and management approval — before relying on any output for a bid, proposal, budget, or contractual commitment.

2. No Warranty

The Software is provided "AS IS" and "AS AVAILABLE," without warranty of any kind, express or implied, including but not limited to warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, or non-infringement. No oral or written information provided by the author shall create any warranty. The author does not warrant that the Software will be error-free or uninterrupted.

3. Limitation of Liability

To the maximum extent permitted by law, the author shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising from or related to the use of, or inability to use, the Software — including but not limited to lost profits, lost bids, bid errors or omissions, cost overruns, business interruption, or loss of data — even if advised of the possibility of such damages. You assume full responsibility for all decisions made and actions taken based on the Software's output.

4. Not Professional Advice

Output from the Software does not constitute engineering, financial, legal, or professional estimating services, and no professional relationship is created by its use. Where professional certification, sealing, or review of an estimate is required, that remains the user's obligation.

6. Demo Version

The free demo is provided for evaluation only, for the stated trial period, and includes a restricted sample of the manhour database. Demo output is for evaluation and must not be used as the basis for a commercial bid or contractual commitment. The demo may not be redistributed, and the trial mechanism may not be circumvented or reset.

7. Updates and/or Support

Updates and/or support are provided as described at the time of purchase, or under an optional annual maintenance arrangement where offered. The author has no obligation to provide perpetual updates, enhancements, or support beyond what is expressly included with your license or maintenance term. Purchased licenses do not expire.

8. General

If any provision of these terms is held unenforceable, the remaining provisions remain in full effect. These terms constitute the entire agreement regarding use of the Software and supersede prior communications on the subject. The author may update these terms for future versions; the terms in effect at the time of your purchase govern your license.
